Alleged Roundup Cancer Victims Continue To File Lawsuits

Lawsuits continue to be filed as cancer victims blame Roundup Herbicide

Monday, May 4, 2020 - So far the vast majority of plaintiffs whom have filed Monsanto Roundup cancer lawsuits for have been mostly limited to occupational users of the product like government and school maintenance workers, professional landscapers, farmers and farmworkers, and the like. Now home gardeners and those that have performed regular weed management maintenance on their home lawns are consulting with Roundup cancer lawyers and filing lawsuits. To date, over 50,000 lawsuits have been filed against Monsanto/Bayer for failing to warn these consumers that glyphosate can bioaccumulate on the skin and cause non-Hodgkin's lymphoma, a rare and deadly form of cancer of the lymph nodes. The latest lawsuit has been filed, according to PlatteCounty Landmark, on behalf of a Weatherby Lake homeowner who used the product for decades on his lawn for cosmetic purposes to kill weeds. According to the Landmark, "James Gordon of Weatherby Lake filed a lawsuit on March 31 alleging the product known as Roundup (weedkiller) caused or contributed to his development of non-Hodgkin's lymphoma. According to the suit, Gordon was diagnosed with cutaneous T-cell lymphoma in 2016 after using the product to maintain the yard around his home on Weatherby Lake. The suit contends Gordon was unaware that exposure to Roundup could cause the development of cancer."

An interesting note was the lawsuit's description of the willful negligence exhibited by Monsanto for failing to warn consumers skin contact with the chemical could cause cancer. The lawsuit describes the company as acting negligently and that the product is "defective and unreasonably dangerous when put to the use reasonably anticipated by the user," according to the Landmark, and that Monsanto knew or should have known of the dangers. Plaintiff DeWayne Lee Johnson was awarded nearly $89 million for the skin cancer he developed from regularly coming into direct contact with Roundup herbicide while performing his job as a California school maintenance engineer and spraying Roundup several times per week for years on or around properties run by the school district. Johnson took the witness stand and was able to show the jury the painful-looking, cancer lesions that pock-marked where his skin was uncovered and he had come into contact with the chemical. His lawsuit claimed Monsanto had the responsibility to warn users that the product could cause cancer and advise them to wear protective waterproof clothing whilst using it.

Plaintiffs suing Monsanto/Bayer today may be delayed as the company works with attorneys that represent thousands of Roundup cancer plaintiffs to hammer out a lump-sum monetary settlement and also because gatherings such as a jury trial are being postponed until the current coronavirus situation can be controlled. Experts estimate that it may cost Bayer another $10-20 billion to settle the matter however, putting lawsuits to rest is a different matter. Cancer such as non-Hodgkin's lymphoma has a latency period of up to 20 years after the first exposure until symptoms become obvious, often giving the cancer time to grow, spread, and become untreatable. Roundup lawsuits could be orders of magnitude greater in number than they are today and could be filed for the next 20 years making today's attempt by Bayer to settle nearly impossible. The company could be faced with setting aside billions every year for the foreseeable future to cover future Roundup cancer claims.
